FEES AND RENTALS

(in force as of January 1st 2010)

Verdegolf Country Club (Club) is an association dedicated to providing its members with a set of services connected to the practice of Golf, as well as promoting and organizing cultural, social, recreational and sporting events.

In order to make these possibilities available, Verdegolf Country Club hires a set of services to Verdegolf – Campos de Golf dos Açores SA, the company which holds and manages Batalha and Furnas’ Golf Courses.

According to the Membership Form/Change in Membership Category, Verdegolf Country Club establishes the amount of the fees and equipment rentals to be paid by each member.

All payments must be made through the Direct Debit System “SDD”, being that the first part of 50% is paid in January and the remaining 50% in July. In alternative you can make one single payment by cheque in the beginning of each year.

The established values for fees and rentals in 2010 are as follows:

SIGN UP FEE

All new members pay one single time the value of the sign up fee as member of Verdegolf Country Club.

ANNUAL FEE FOR PLAYING MEMBER

OPTION 1

Includes:
• The annual fee paid by the member gives him the right to use the golf courses without any additional cost for the period of one year;
• Unlimited use of a hand trolley;
• Discount on green fees for guests (up to three guests per visit);
• Acquisition of products and services on the shops, restaurants and bars of the Clubhouses with a 10% discount;
• Access to the exclusive parking area in the Clubhouses;
• Annual credit of 200 € to be used in the restaurants and bars of the Clubhouses through a voucher system;
• Family Annual Green Fee includes spouse and two junior dependants under 21 years of age.

OPTION 2

Includes:
• Green fees with reduced prices exclusively for members;
• Green Fee discount for guests (up to three guests per visit);
• Acquisition of products and services on the shops, restaurants and bars of the Clubhouses with a 10% discount;
• Access to the exclusive parking area in the Clubhouses;
• Annual credit of 120 € to be used in the restaurants and bars of the Clubhouses through a voucher system.

ANNUAL FEE FOR SOCIAL MEMBER

Includes
• Exclusive Green Fees for social members;
• Green Fee discount for guests (50% discount on balcony price);
• Acquisition of products and services on the shops, restaurants and bars of the Clubhouses with a 10% discount;
• Access to the exclusive parking area in the Clubhouses;
• Annual credit of 100 € to be used in the restaurants and bars of the Clubhouses through a voucher system.

Student Member (from 21 through to 25 years of age)

Conditions:
- Presentation of enrollment proof and payment of student fees;
- Age between 21 and 25.

Includes:
• Green fees with reduced prices exclusively for members;
• Acquisition of products and services on the shops, restaurants and bars of the Clubhouses with a 10% discount;
• Access to the exclusive parking area in the Clubhouses.

Special Program for Physical Education Teachers

Includes:
• Green fees with reduced prices exclusively for members;
• Credit for six 30-minut individual golf initiation classes;
• Acquisition of products and services on the shops, restaurants and bars of the Clubhouses at discount prices;
• € 50.00 credit to be used in the restaurants of Batalha and Furnas’ Clubhouses, through a vouchers system to be be delivered in the Proshop.

SIGN UP FEE AND MONTHLY FEES FOR JUNIORS

Includes:
• The annual fee paid by the Junior gives him the right to use the golf courses without any additional cost during that period;
• Golf Lessons according to category and the rules established in the Golf Academy;
• Unlimited use of a hand trolley;
• Acquisition of products and services on the shops, restaurants and bars of the Clubhouses with a 10% discount;
• Access to the exclusive parking area in the Clubhouses.

ANNUAL FEE FOR NON-RESIDENT MEMBER

To enjoy the non-resident membership fee, the member must:
• Present proof of his residency outside the Azores;
• To reside outside the Azores for more than six months.

Includes:
• Green fees with reduced prices exclusively for members;
• Green fee discount for guests (up to six guests per year);
• Acquisition of products and services on the shops, restaurants and bars of the Clubhouses with a 10% discount;
• Access to the exclusive parking area in the Clubhouses.

ANNUAL RENTALS FOR ALL MEMBERS

• These rentals are defined according to the VerdeGolf S.A.’s internal policy;
• The annual rentals can only be made by one person only;
• According to VerdeGolf S.A.’s internal policies, the buggy must be shared by two people.

All the values of fees and rentals may be periodically reviewed.

The Member Guest Green Fee use is limited to 5 annual uses per annum for the guest player.
- The guest player must present his identification at the Pro-Shops.

ANNUAL FEES PAYMENT

The annual fees are invoiced by Verdegolf Country Club in full at the beginning of each
year and the Members may choose one of two methods of payment:
- A single payment by cheque at the beginning of each year, with delivery of the respective receipt, valid post good collection.
- Payment in two installments through direct debit system. In this case you must fill out the Direct Debit authorization form (SDD) until the end of December of the year before. The payment will be made according to the rules of the Bank of Portugal for this way of payment and the receipt will be sent by mail after confirmation of the bank transfer.

VOUCHER SYSTEM

Voucher value for each Member
The total annual value of vouchers to be handed out to each Member will be the following, according to the Member’s category:

Generic Notes on the usage of the annual credit at the Restaurants of the Clubhouses through voucher system

The vouchers will always be handed in two moments of the year, 50% in January na the remaining in July, always after good collection of the respective fees and independently of the mode of payment chosen.

The total value will be divided in single vouchers of 10 € each.

Each voucher is personalized with the Member number, will present sequential numbering and an expiring date.

The vouchers can only be used by the Member himself, whether he is accompanied by family and friends or not.

The vouchers must always be used on a date prior to the one printed on them. From that date on they will, in no situation whatsoever, be redeemable in money.

Generically it is understood that a voucher is a document that attributes a discount or bonus in a purchase and, in being so, it does not comprise the same value in money. So, in case of an expense below 10 € (ten euros) and you handing out the voucher, there will be no return of change.

The use of vouchers is not to be cumulated with other promotions or discounts in force at the Clubhouses, namely the 10% discount to which the Members are already entitled to.

The vouchers will be handed to the Members after full payment of the value of their fees.

In case of loss of the vouchers, the right to restitution of that value is not attributed.

NEW MEMBER SIGN UP

Procedures for a New Member Sign Up

A. Any person who wishes to become a member of Verdegolf Country Club must present a Membership form fully filled out, indicating which Member category he/she wishes to fit in.
B. The Membership Form and the direct debit authorization are available at the Batalha Clubhouse.
C. All the filled out forms must be delivered at the Batalha Golf Course Reception/Front Desk at the care of the VerdeGolf Country Club’s Treasure Responsible, with the signatures of the two proposing Members.
D. The Board of Verdegolf Country Club and, when necessary, the Board of Verdegolf – Campos de Golf dos Açores, S.A., must deliberate separately and confidentially about the membership application, within two weeks of the proposal, as to inquire motives that may lead to its acceptance or rejection.
E. It is Verdegolf Country Club’s Board competence to establish the deadlines for analysis and eventual acceptance of the memberships’ applications.
F. In no case the determinant criteria for acceptance or rejection of a membership application, determined by VGCC’s Board, may discriminate any person or persons because of their race, marital status/family status, sex, religion, creed, ancestry, age, handicap, nationality or any other of discretionary attribution with subjective character.
G. If the rejection of the membership application is contested by the member applicant, the Board of Verdegolf Country Club must review the request one more time, with the applicant, and solve the contestation.
H. The final decision about who is accepted as member is of the exclusive competence of the Board of Verdegolf Country Club.

Application acceptance

A. After the approval of the individual membership application, the Club must send a Welcoming Letter or E-Mail if so, where it provides the new member with his Identification Number, VerdeGolf Country Club’s Statutes and the respective invoice/receipt.
B. After accepting the condition of VerdeGolf Country Club Member, the new member undertakes to respect the Rules and Regulations of VerdeGolf, S.A..
C. The Golf Manager of VerdeGolf, S.A. or someone that he/she indicates, will show the new member the Clubhouses and respective facilities and services.

Members’ Responsability

A. Members shall abide by all the rules set out in the Statutes of VerdeGolf Country Club and the Internal Regulations of VerdeGolf – Campos de Golf dos Açores, S.A.,being that the later is available in the Clubhouses for consultation.
B. Members are responsible for the regularization of all fees, charges and other debts incurred by him/herself and His/her family and/or guests.
C. Members are responsible for their own conduct and behaviour and that of their family and guests.
D. Members must maintain propriety in their words and actions as to neither to smite the good name of the Club nor trouble or distress their fellow members.

Sanctions

A. Suspension: The member that no longer abides what is disposed in these Conditions and in the VerdeGolf, S.A.’s internal regulations or practices acts from which may result the discredit of the Club, incurs, according to the gravity of the matter, in the penalties of admonishment, censorship, suspension up to 2 years or expulsion, all of which will be enforced by the Board. The expulsion penalty is also applicable, on the terms of the previous paragraph, to the one who, by reprehensible social conduct post to his admission may come to belittle in the concept of the associates.
B. Admonishment: The admonishment will be communicated privately to the Member, by the Board. To impose the penalties of censorship, suspension and expulsion, a disciplinary procedure must be organized, the Board providing the needed and convenient steps and
will always hear the member. The penalty of suspension up to 2 years implies, during the period of accomplishment of the penalty, the continuance of the payment of the membership fees, not being allowed appeal during that period to the provided mechanism. The Member who has been excluded can only be re-admitted after five years, being obliged to pay the sign up fee in full as well as possible debts contracted regarding the Club.
The re-admission predicted in this article can only be verified by the unanimous vote of the Board.

Complaints

A. The requests, suggestions and complaints must be presented in writing to the Board of VerdeGolf Country Club.
B. All complaints concerning VerdeGolf S.A.’s facilities, its employees or the behaviour of other members, their families or their guests, must be communicated directly to the Executive Comission of VerdeGolf S.A., in writing to the address of the Batalha Golf Course or by e-mail to This e-mail address is being protected from spambots.
